Terms of Service
The conditions you accept when browsing or buying at Holiday Harbor. They cover acceptable use of the site, how orders and payments work, delivery and returns, care of seasonal decorations, the limits of our liability and which law governs a dispute.
Using this website
Browsing the site means you accept these conditions. Use it lawfully and do not scrape it, probe it for vulnerabilities, submit automated orders or do anything that degrades the service for other customers.
Access may be withdrawn where fraud or persistent misuse comes to light, and orders placed by machine may be cancelled without notice.
If these conditions do not suit you, please do not use the site. You are welcome to ask about any clause before buying, and we will answer in plain language.
You are responsible for keeping any account credentials confidential where the site issues them, and for telling us promptly if you believe someone else has obtained them.
We may change, suspend or withdraw part of the site without notice where maintenance or a security issue requires it. Where a change affects an order already placed, we will contact you rather than leave you to discover it.
Orders and availability
An order is an offer rather than a completed contract, and a contract forms only once we confirm dispatch. We may decline an order where stock has gone, payment cannot be verified, the delivery address is incomplete or fraud is suspected.
Any paid order we cancel is repaid in full, and we give a reason rather than leaving the cancellation unexplained.
Stock is held in limited quantities and ranges change through the year, so the product page is the only dependable guide to what is actually available at any moment.
Where an item is shown as available but turns out not to be, we tell you before taking payment rather than after, and you are free to cancel the rest of the order at that point.
Order confirmation emails are a record rather than a guarantee. The dispatch email is the point at which the contract is complete and the parcel is on its way.
Prices, tax and payment
Prices appear in US dollars and may change without notice, though the figure confirmed on your order email is the one that binds the sale.
Sales tax is calculated at checkout from the delivery address, because rates differ between states and localities.
Payment is taken on the processor's own hosted page. The major card networks and PayPal are accepted, and full card numbers are never stored on our systems.
Where a price was displayed incorrectly because of a technical fault, we contact you before dispatch and you may proceed at the corrected price or withdraw for a full refund.
Where a promotion has been applied, the discounted figure is shown before you confirm the order and is the figure used for any refund.
We do not apply a surcharge for using a credit card, and we do not offer a discount for paying by any particular method.
Delivery
Delivery dates are forecasts rather than promises, and we are not answerable for delays caused by the carrier, severe weather or an address that was not completed correctly.
Risk passes to you on delivery, but where a parcel is lost or damaged in transit we pursue the carrier on your behalf and then replace or refund it once a claim is settled.
A delivery that fails because the address was wrong leaves the customer liable for the cost of retrieving the parcel and sending it out again, unless the mistake was ours.
Where a carrier offers a delivery window or a collection point, that arrangement is between you and the carrier once the parcel is in their network.
We are not able to redirect a parcel to a different address after dispatch, so please check the delivery details before confirming.
Returns and refunds
Unused items may be returned within 30 days of delivery on the terms set out in our Return Policy, which forms part of these conditions.
Refunds reach the original payment method once the returned item has been received and inspected, and the Return Policy carries the full detail on eligibility, exclusions, carriage and timing.
Where these conditions and the Return Policy appear to conflict over a return, the Return Policy is the more specific document and prevails.
Returned items remain your responsibility until they reach us, which is why we recommend a tracked service for anything of value.
Where a refund is due but the original payment method has expired, contact us and we will arrange an alternative once the bank confirms the card is closed.
The Return Policy sets out the practical steps, and this section only records that it forms part of the agreement you accepted at checkout.
Product care and safe use
Seasonal decorations are not toys and are not intended for unsupervised use by children. Inflatable and light-up pieces should be connected to a residual current device where one is available, kept clear of standing water, and unplugged before the weather turns; battery garlands and pop-up trees should be switched off when nobody is present. Fabric, tinsel and flocked garlands must be kept away from candles, heaters and open flames.
Outdoor pieces are designed for lawns, porches and covered positions rather than permanent exposure. Bring inflatables in during storms or when the supplier's temperature range is exceeded, and do not run a cable across a path where it can be pinched or walked on. Check the plug, cable and controller each time a set is unpacked, and stop using anything with exposed wire, a cracked housing or a scorched connector.
Before storage, let every piece dry completely, remove the batteries, coil the cable loosely and put the set back in its box or a lidded container. Do not hang a heavy piece from a single nail, and keep anchors clear of pipes and cables hidden inside the wall.
Intellectual property
The words, photographs, graphics, page layout and the Holiday Harbor name on this site belong to us or are used under licence, and they may not be reproduced without written permission.
Linking to a product page and quoting a short passage in a review or article is welcome, and we are happy to supply images for genuine editorial use on request.
Copying our photography onto another storefront or into paid advertising is not permitted. If you believe material here infringes your own rights, tell us and we will look into it promptly.
Product names, logos and brand marks belonging to third parties remain the property of their owners, and nothing on this site grants a licence to use them.
You may not use our name, logo or product photography in a way that suggests we endorse or are connected with your own business, and you may not register a domain or social account that imitates ours.
Conduct we do not permit
Nothing unlawful, abusive or misleading may be submitted through the site, no one else's payment details may be used, and the security or availability of the service must not be interfered with.
Ordering goods with no intention of paying, or repeatedly returning used items as though the policy were a free lending service, is equally forbidden.
Orders may be cancelled and accounts closed where these rules are broken, and fraudulent payment activity may be reported to the relevant authorities.
We may ask for additional verification on an order that looks unusual. That is a routine check rather than an accusation, and it is released as soon as the details match.
We may suspend an account while an investigation is open, and we will tell you why the account has been paused rather than leaving it unexplained.
Where a payment is reversed without contact, we may require a different payment method on any future order while the matter is resolved.
The limits of our liability
So far as the law permits, Holiday Harbor is not answerable for indirect or consequential losses flowing from the use of the site or from the purchase of a product.
Nothing in this clause covers death or personal injury caused by negligence, or fraud, and nothing removes a statutory right that cannot be waived by agreement.
Our exposure on any claim connected with an order is limited to the sum you actually paid for that order.
Where a product is sold with a manufacturer's warranty, that warranty runs alongside these conditions rather than replacing them.
We do not exclude liability for anything the law does not allow us to exclude, including liability for faulty goods or for losses that cannot be limited under consumer law in your state.
Where a product causes damage to property, the position depends on whether the item was used as intended and on the terms of any manufacturer warranty, and we will set out the options once we understand what happened.
Nothing in this section is intended to discourage you from raising a genuine problem, and it does not shorten any period in which you are entitled to bring a claim.
Changes to these conditions
These conditions may be amended to reflect changes in how the business operates or in the law, and the version published on this page is the one that applies.
Continuing to use the site after an amendment amounts to acceptance of the amended conditions, and the revision date at the top of the page shows when it changed.
Amendments never reach back to orders already placed, so the conditions in force at the time of your purchase continue to govern that purchase.
If a change materially reduces your rights, we will make that clear at the top of the page rather than leaving it to be discovered in the text.
We keep the previous version of these conditions on file, and we can tell you which version applied to a particular order if you ask.
If a change is required by law, it takes effect from the date the law requires rather than from the date we publish it, and we will say so where that happens.
Governing law and disputes
These conditions are governed by the law of the United States and of the state in which our registered office is located, disregarding its conflict-of-law rules.
Where a disagreement cannot be settled by correspondence, both sides agree to attempt mediation before proceedings are issued.
The courts of that state hold exclusive jurisdiction, and nothing in this clause prevents you from approaching a consumer-protection body or a small-claims procedure available where you live.
Before any formal step, write to us with the order reference and a short description of the problem. Most disagreements are resolved at that stage.
The law that applies does not remove protections you have under the consumer law of the state or country where you live, and those protections apply alongside this clause.
If you are a consumer in a jurisdiction that gives you the right to bring proceedings locally, nothing here takes that right away.
